This action was brought by the parents of Luis A. Mariscal, Jr., pursuant to Arizonas Wrongful Death Act, A.R.S. § 12-611, et seq., against the American Smelting and Refining Company and others, alleging that the plaintiffs were damaged by the deprival of the love, affection, guidance, solace and companionship of their son. Decedent was 23 years of age when he was killed in an accident while working for the company. He was unmarried, had no dependents, was not contributing to the support of his parents, and was subject to the provisions of Arizonas Workmens Compensation Act. In the Superior Court, a summary judgment was entered in favor of defendants. The Court of Appeals affirmed. We accepted jurisdiction on review. Opinion of the Court of Appeals, 24 Ariz. App. 161, 536 P.2d 1053 (1975), vacated.

Early in January, 1943, petitioner came to Phoenix and was treated and examined by several doctors; x-rays were also taken. The evidence disclosed that in mid-January his left chest, back and left side were sore, he spit up a little blood, was weak and had pain in the left chest. He was suffering from an advanced stage of osteo-arthritis of the lower dorsal region of the spine; also from silicosis moderately advanced. The films showed the broken ribs to be in good condition. Some of these ribs were fractured near their attachment to the spine but had united in proper alignment. The medical evidence disclosed that petitioner was suffering from spondylitis deformans or hypertrophic spondylitis of long standing and progressive character, which was aggravated by the injury.

Applicant, Nielsen, after working for the Smelting Company for 10 days, was injured by a cave-in in 1952. Among other things he injured his knee. The company, as self-insurer, paid statutory compensation for a period of time under Sec. 35-1-66, Utah Code Annotated 1953, which provided for payment upwards of six years from the date of the injury. After he had been paid compensation periodically for a time under the statute, Nielsen requested and received a lump sum settlement of his claim in order to go into private business, which he did, and which he pursed until 1965, when he had his knee cap removed, in the process of which he suffered partial paralysis of his hands and arms because of operative or post-operative faulty blood circulation.

This is the second appeal by defendants Pechiney Ugine Kuhlmann and Trefimetaux from an order of the district court finding that they are not immune from suit under the Foreign Sovereign Immunities Act of 1976, 28 U.S.C. 1330, 1332(a)(2),(4), 1391(f), 1441(d), 1602-1622 ("FSIA"). On the prior occasion, we remanded the cause for a factual inquiry into circumstances relevant to application of the FSIA in this case.

This study focuses on the study of metallurgy in pre-colonial Zambia to 1890. A general review of the literature on metallurgy in pre-colonial Zambia reveals that during the period our study (up to 1890), three metals were mined.
